Terms and conditions
§ 1 Scope and provider
These terms apply to every order placed by a consumer through this online shop with DeshiGo UG (haftungsbeschränkt), Bernauer Straße 28, 10115 Berlin. A consumer is any natural person entering into a transaction for purposes that are predominantly outside their trade, business or profession. We supply consumers only.
§ 2 How a contract is formed
- Showing goods in this shop is not a binding offer. It is an invitation for you to place an order.
- Submitting your order with the “Order with obligation to pay” button is a binding offer to buy the items in your basket.
- The contract is formed when we send you the order confirmation by email. That email is also your invoice.
- We store the contract text and send it to you with the order confirmation.
§ 3 Prices, unit prices and goods sold by weight
- All prices shown are total prices and include VAT at the statutory rate. Delivery costs are charged in addition and are shown to you before you place your order.
- For pre-packaged goods we also show the unit price per kilogram or litre.
- Some goods — fish in particular — are sold by weight. The amount shown in the shop is an estimate based on a typical piece. The price that applies is the one calculated from the actual weight, which we establish by weighing before delivery. The final amount may therefore differ from your order confirmation, and we tell you what it is before the delivery is on its way.
§ 4 Delivery area, delivery costs and minimum order
- Within Berlin we deliver ourselves. Outside Berlin we send a Hermes parcel.
- Chilled and fresh goods are delivered within Berlin only. Those items cannot go into a parcel; an order that contains them for an address outside Berlin is refused before it is placed, and the items concerned are named.
- Delivery costs, the minimum order value and the threshold for free delivery depend on your delivery address. The amounts that apply to your order are shown at checkout before you place it.
§ 5 Delivery dates and order cut-off
- Orders received on a day we are open, before our daily order cut-off, are delivered within Berlin the same day.
- If your order arrives later than that, or the shop is closed, we deliver on the next day we are open. We tell you the intended delivery day before you place the order and again in the order confirmation.
§ 6 Items that turn out to be unavailable
We sell fresh goods, and stock changes through the day. If an item is no longer available when we put your order together, it is dropped. We do not charge for it, and we refund it if you have already paid. The contract for the remaining items stands.
§ 7 Payment
- For deliveries within Berlin you may pay in cash on delivery.
- Where offered, you may pay online. Payment is handled by our payment provider Stripe Payments Europe, Ltd. You are taken to a page hosted by Stripe; your payment details never reach us.
- Cash payment is not available for parcels sent outside Berlin.
§ 8 Retention of title
The goods remain our property until they are paid for in full.
§ 9 Defects
Your statutory rights in respect of defects apply. With food, please check the goods on delivery and tell us about any obvious defect as soon as you reasonably can, using the contact details in our legal notice. This does not restrict your statutory rights.
§ 10 Right of withdrawal
As a consumer you have a right of withdrawal. The details, and the statutory exceptions — in particular for goods that spoil quickly — are set out in our right of withdrawal notice.
§ 11 Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
§ 12 Governing law and contract language
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country where you habitually reside are unaffected. The contract languages are German and English. Where the two versions differ, the German version prevails.
